The attorneys Clark Newhall, MD, JD and Cheri Skinner-Gochberg, JD, along with their support team, have unique experience and expertise in the area of FELA litigation.
Ms. Skinner-Gochberg spent four years as in-house counsel with Union Pacific Railroad. She has litigated more than twenty railroad cases involving everything from wrongful death claims, traumatic injuries, employment disputes, to cumulative trauma claims. Ms. Skinner-Gochberg is intimately familiar with railroad law including:
- The Federal Employees Liability Act;
- The Federal Locomotive Inspection Act; and
- The Safety Appliances Act.
In addition, because of her “inside” experience, Ms. Skinner-Gochberg is familiar with the railroad practices in handling claims and cases filed against the railroad, including:
- The guidelines used by claims representatives and the Law/Claims Department in evaluating the worth of claims;
- The problematic interference by railroad management and claims representatives in the reporting of injuries and the treatment of injured employees;
- The Law/Claims Department settlement goals and tactics employed in settlement negotiations;
- The Railroad’s pay and bonus structure that encourages the Law/Claims Department to “hold claims direct” and/or settle claims and suits for far less than the real value of the claim.
Dr. Clark Newhall is not only a skilled and tenacious litigator, but has practiced medicine for over 20 years. Dr. Newhall’s medical experience (primarily in emergency medicine) is something you will unlikely find in any other FELA law firm. We find that attorneys on the other side of our lawsuits are no match against us when it comes to identifying, ferreting out and understanding medical issues, especially in investigations, depositions, discovery and at trial.
In addition, we have a “team” of professionals prepared to serve railroad employee needs including field agents, investigators, treating doctors, IME doctors, and rehabilitation specialists (one of whom was retained by the railroad in the past until she became uncomfortable with their practices).
Railroad employees in Utah, Idaho, Wyoming, Montana and surrounding states benefit from the representation and individual attention that only a local firm such as ours can provide. The railroad has local counsel and claims representatives. Railroad employees deserve the same! Our firm is committed to be on call 24 hours a day, seven days a week, to answer questions, meet with railroad employees and family members, investigate accidents, ensure employees’ rights are protected, advise railroad employees and attend local Union meetings.
